Fiancé Visa (K-1) Explained: Bringing Your Loved One to the U.S.

The K-1 visa, commonly known as the fiancé visa, allows U.S. citizens to bring their foreign fiancé(e) to the U.S. so they can marry. This visa grants your fiancé(e) permission to enter the country with the requirement that you get married within 90 days of arrival. Here’s a breakdown of how the K-1 visa works and how you can start the process.

Eligibility for the K-1 Visa

To be eligible for the K-1 visa, you and your fiancé(e) must meet the following requirements:

  • You are a U.S. citizen.
  • You and your fiancé(e) intend to marry within 90 days of their arrival in the U.S.
  • Both of you are legally able to marry (i.e., both are of legal age and any prior marriages have been legally terminated).
  • You have met each other in person at least once in the past two years, with certain exceptions allowed for cultural or religious practices.

Steps to Apply for a Fiancé Visa

  1. File Form I-129F: This petition establishes that you are engaged to a foreign citizen and are requesting permission for them to come to the U.S. to marry. Proof showing your relationship and your intent to marry is required.
  2. Wait for USCIS and NVC Approval: Once Form I-129F is approved by U.S. Citizenship and Immigration Services (USCIS), it is forwarded to the National Visa Center (NVC), which will contact your fiancé(e) to apply for the K-1 visa at the U.S. Embassy or Consulate in their country.
  3. Attend a Visa Interview: Your fiancé(e) will be required to attend an interview and provide supporting documents like medical records and proof of financial support.
  4. Enter the U.S. and Get Married: Upon visa approval, your fiancé(e) has six months to travel to the U.S., and once they arrive, you must marry within 90 days. After marriage, your new spouse can apply for a green card.
