Obtaining a Green Card Through Marriage: Step-by-Step Guide

Getting your green card through marriage is a common path for spouses of U.S. citizens or permanent residents. This guide simplifies the process to help you navigate it smoothly.

1. Determine Eligibility

You must be legally married to a U.S. citizen or lawful permanent resident to apply. It must be genuine and not solely for immigration purposes, with evidence like joint bank accounts, photos, and affidavits from friends and family.

2. File Form I-130

The U.S. citizen or permanent resident spouse should to file Form I-130, Petition for Alien Relative, with U.S. Citizenship and Immigration Services (USCIS). Submit supporting documents, including proof of the petitioner’s status and evidence of the marriage.

3. Receive Notice of Action

After filing Form I-130, USCIS will send a Notice of Action (Form I-797) acknowledging receipt of the petition. This confirms the start of the process.

4. File Form I-485 (if in the U.S.)

If the foreign spouse is in the U.S., they can file Form I-485, Application to Register Permanent Residence or Adjust Status. This can be filed concurrently with or after the I-130 approval, adjusting the status from a temporary visa to a green card.

5. Attend Biometrics Appointment

USCIS will schedule a biometrics appointment for fingerprints, photos, and a signature. This is used for background checks.

6. Attend the Interview

Both spouses must attend an interview to assess the authenticity of the marriage. Be prepared with original documents and additional evidence of your genuine marriage.

7. Receive Decision

If the interview is successful and all documents are in order, USCIS will approve the green card application. The foreign spouse will then receive a Conditional Permanent Resident Card if the marriage is less than two years old, valid for two years.

8. Remove Conditions on Residence

To remove conditions on the green card, file Form I-751, Petition to Remove Conditions on Residence, within 90 days before the card expires. This requires more evidence of a continued genuine marriage.
